Terms governing access to the FOS ERP website, trial environments, and subscription services for manufacturing customers.

These Terms of Service ("Terms") apply between you ("Customer", "you") and Factory Operating System ERP ("FOS") when you access our website or use FOS software and related services.

1. Services

FOS provides cloud ERP software for manufacturing, implementation, training, and support as described in your order form or statement of work. Features may evolve; material reductions will be communicated per your agreement.

2. Accounts & access

You are responsible for credentials, user provisioning, and activity under your accounts. Notify us promptly of unauthorized access.

3. Customer data

You retain ownership of data entered into FOS. You grant FOS a limited license to host, process, and back up data solely to provide the services. Our Privacy Policy explains handling of personal data.

4. Acceptable use

  • No reverse engineering, scraping, or interference with platform security.
  • No unlawful content or use that violates third-party rights.
  • Compliance with applicable export, tax, and manufacturing regulations in your jurisdiction.

5. Fees & payment

Subscription fees, implementation, and support are per your commercial agreement. Late payments may suspend access after notice. Taxes are your responsibility unless stated otherwise.

6. Confidentiality & IP

Each party protects the other's confidential information. FOS retains all rights in the platform; you receive a non-exclusive subscription license during the term.

7. Warranties & liability

Services are provided as agreed in your contract. To the extent permitted by law, indirect and consequential damages are excluded; aggregate liability is capped per your order form.

8. Termination

Either party may terminate per the agreement. Upon termination, you may export data within the agreed window; FOS will delete data per retention policy.

9. Governing law

These Terms are governed by the laws of India. Courts in Pune, Maharashtra have exclusive jurisdiction unless otherwise agreed in writing.
